What happens if I don't pay my Spanish non-resident tax?

Short answer

The debt does not go away. If you never file, the tax office can assess you with interest and possibly a penalty. If you file but do not pay, it moves to enforced collection with a surcharge of 5%, 10% or 20% depending on when you settle, and can ultimately recover the debt from Spanish assets.

Two different situations

You never filed. As long as the tax office has not contacted you, you can still file late at the reduced voluntary surcharge: 1% plus 1% per full month, or 15% plus interest after a year. Once it writes to you, that option closes. It can then calculate the tax itself, add interest and open a penalty procedure, which is generally costlier.

You filed but did not pay. A return filed with the payment failing, for instance because a transfer was returned for a wrong reference, leaves an unpaid debt. When the voluntary period ends, the tax office issues a providencia de apremio. The surcharge is 5%, 10% or 20% of the debt depending on how quickly you pay after that stage.

How the tax office collects

Spain does not need you to live in Spain to recover a tax debt linked to Spanish property. Enforced collection can, in the end, reach Spanish assets such as a bank account, rent paid in Spain or a refund due to you, and an unpaid debt can complicate a future sale. For a debt of a few hundred euros, letting it reach that stage makes little sense.

A quick illustration

Liam, a UK resident, owes €264 for his flat. He pays on time: €264. He pays three months late, before any letter: 4% surcharge, €10.56, reduced to €7.92 if paid within the notified period. He files but his transfer bounces and he ignores the follow-up until enforcement: a surcharge of up to 20%, or €52.80.

The way out

  • If you have never filed, file now. See never filed.
  • If a payment failed, generate a new payment document and pay again. Our page on paying from abroad explains the transfer reference rule that causes most failures.
  • If you have a letter, read what to do with an AEAT letter and act within its deadline.
