Key points – Fiscasa is a private service, independent of the Agencia Tributaria. We prepare your return; you remain the taxpayer, you sign it and you pay the tax directly to the Spanish tax authority. Our prices are shown including VAT. You have a 14-day right of withdrawal, which you lose if you expressly ask for the service to be fully performed before the end of that period. Our guarantee reimburses, up to a cap, surcharges and interest resulting from a calculation error on our part.
Article 1 – Purpose and scope
1.1. These general terms of sale (the "Terms") govern the contractual relationship between:
- [COMPANY NAME], [LEGAL FORM] with share capital of €[SHARE CAPITAL], whose registered office is at [ADDRESS], registered with the RCS of [CITY] under number [RCS NUMBER], SIRET [SIRET], VAT number [VAT NUMBER], email [EMAIL], operating the "Fiscasa" service (hereinafter "Fiscasa" or "we");
- and any natural person who orders a service on the website [DOMAIN NAME] (hereinafter "the Client" or "you").
1.2. The Terms apply to the exclusion of all other terms. The Client declares that they have read and accepted them before placing an order, by ticking a box. They are accessible at any time on the site and can be downloaded and printed.
1.3. Fiscasa may amend the Terms at any time. The applicable Terms are those in force on the date of the order.
Article 2 – Status of Fiscasa
2.1. Fiscasa is a private service, independent of the Agencia Estatal de Administración Tributaria (AEAT) and of any Spanish or French public authority. Fiscasa does not act in the name or on behalf of these authorities and is not a colaborador social of the AEAT.
2.2. Fiscasa is not a gestor administrativo, a lawyer or a chartered accountant. The service consists of assistance in preparing Spanish tax returns; it does not include representing the Client before the tax authority or the courts, nor legal advice beyond the returns ordered.
Article 3 – Description of services
3.1. Depending on the plan chosen, the service includes:
- preparation of the Client's Modelo 210 return (imputed income, letting or capital gain) for the property and year specified, based on the information and documents the Client provides;
- provision of the pre-filled official form ready to be signed and filed, and payment instructions in English (payment ID, amount, reference);
- where applicable, catching up on previous years, with an estimate of the applicable surcharges (recargos) and interest;
- where applicable, a summary to assist with the return in the country of residence (for example form 2047 in France or the SA106 pages in the UK), which is an aid to completing that return and not a return in itself;
- support by email and [OTHER CHANNELS] in English for the duration of the service.
3.2. The exact content of each plan and the number of properties, owners and years covered are set out on the Pricing page and summarised before the order is confirmed.
3.3. Household price: unless stated otherwise, a "household" plan covers the returns of members of the same household (married couples or civil partners and, where applicable, [OTHER PERSONS COVERED]) who co-own the same property, for the same year.
3.4. Excluded from the service, unless a specific plan provides otherwise: payment of the tax on the Client's behalf, responding to inspections and claims by the tax authority, administrative or court appeals, the tax return in the country of residence, obtaining the NIE, the digital certificate or Cl@ve, and local taxes (IBI, municipal plusvalía).
Article 4 – The Client's responsibility as taxpayer
4.1. The Client remains the sole taxpayer and solely responsible to the Spanish tax authority for their filing and payment obligations.
4.2. The Client undertakes to provide accurate, complete and up-to-date information (identity, NIE, tax residence, ownership share, dates, cadastral value, rent, expenses, supporting documents) and to report any change.
4.3. The Client reviews and approves the prepared return before signing and filing it. The Client pays the tax directly to the Spanish tax authority, within the deadlines and according to the instructions provided. Fiscasa never collects the tax.
4.4. Where filing requires an action by the Client (signature, filing, transfer), Fiscasa cannot be held liable for any delay or failure attributable to the absence or late performance of that action.
Article 5 – Ordering
5.1. The Client selects the plan, provides the information requested, reviews the summary (content, price incl. VAT) and confirms the order with an obligation to pay.
5.2. Fiscasa confirms the order by email, with the Terms in force, on a durable medium.
5.3. Fiscasa may refuse an order where the Client's situation falls outside the scope of the service (for example a company owning the property, a permanent establishment, ongoing litigation), or where legal identity verification obligations cannot be met. Any amount paid is then refunded in full.
Article 6 – Prices and payment
6.1. Prices are shown in euros, including all taxes (incl. VAT). They include VAT at the applicable rate.
6.2. Prices do not include the Spanish tax, any surcharges, interest or penalties owed to the tax authority, or the Client's bank charges.
6.3. Payment is due on ordering, by [PAYMENT METHODS, e.g. bank card, bank transfer], via the payment provider [PAYMENT PROVIDER]. Fiscasa does not have access to full card details.
6.4. An invoice is sent to the Client electronically.
Article 7 – Performance of the service
7.1. Fiscasa begins the service as soon as it receives the necessary information. Indicative timescales are set out on the Pricing page.
7.2. For orders placed less than [NUMBER] days before a legal deadline, and provided complete information is supplied, Fiscasa will endeavour to deliver before the deadline; if complete information has not been received at least [NUMBER] days before the deadline, Fiscasa cannot guarantee that the deadline will be met.
7.3. The service is deemed fully performed when the prepared return and payment instructions are delivered to the Client.
Article 8 – Right of withdrawal
8.1. In accordance with articles L. 221-18 et seq. of the French Consumer Code, a Client who is a consumer has fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to give reasons or bear any costs other than those provided for below.
8.2. Performance before the end of the period. If the Client wishes the service to begin before the end of the withdrawal period, they expressly request this when ordering (tick box). If they withdraw after the service has begun but before it has been fully performed, they pay an amount proportionate to the service provided up to the time they communicate their decision to withdraw (article L. 221-25 of the French Consumer Code).
8.3. Loss of the right of withdrawal. In accordance with article L. 221-28, 1° of the French Consumer Code, the right of withdrawal can no longer be exercised once the service has been fully performed before the end of the withdrawal period, if performance began with the Client's prior express consent and express waiver of their right of withdrawal. When ordering, the Client is asked to tick a separate box to this effect.
8.4. Exercising the right. The Client gives notice of their decision by an unambiguous statement, by email to [EMAIL] or by post to [ADDRESS], or using the model form in the annex.
8.5. Refund. Fiscasa refunds the amounts due no later than fourteen days after receiving the withdrawal decision, using the same means of payment as for the order, unless otherwise agreed.
Article 9 – Fiscasa guarantee
9.1. Purpose. If a calculation error attributable to Fiscasa in a return prepared by Fiscasa results in the Client having to pay surcharges (recargos), late-payment interest or penalties to the Spanish tax authority, Fiscasa reimburses the Client for the amount of those surcharges, interest and penalties.
9.2. Cap. Reimbursement is limited to €[CAP] per return and €[ANNUAL CAP] per household per calendar year, and may not exceed [MULTIPLE] times the price paid for the service concerned, unless mandatory legal provisions provide otherwise.
9.3. What is not covered:
- the tax itself, which was due in any event;
- the consequences of inaccurate, incomplete or late information or documents provided by the Client;
- the consequences of a late, incomplete or incorrectly made payment by the Client (reference, amount, expired ID), or of the Client's failure to file or sign;
- changes in legislation, doctrine or administrative interpretation after the return was delivered;
- situations where the Client changed the return after it was delivered;
- surcharges relating to years for which the Client was already late at the time of ordering, for the part corresponding to that earlier delay.
9.4. Making a claim. The Client sends their claim to [EMAIL] within [PERIOD] of the tax authority's notice, together with that notice and the proof of payment. Fiscasa examines the claim and, if it is justified, makes the reimbursement within [REIMBURSEMENT PERIOD]. With the Client's agreement, Fiscasa may prepare the necessary corrective return free of charge.
9.5. This commercial guarantee is in addition to the Client's statutory rights and does not limit them.
Article 10 – Liability
10.1. Fiscasa is bound by an obligation of means (best endeavours). It exercises the diligence of a reasonably competent provider to prepare accurate returns based on the information provided.
10.2. Outside the guarantee in article 9, and except in the case of gross negligence or wilful misconduct, personal injury or mandatory legal provisions, Fiscasa's liability is limited to direct and foreseeable damage, up to [LIABILITY CAP].
10.3. The guides, articles and calculator on the site are for general information. The calculator's results are estimates and only bind Fiscasa once the service has been ordered and the return prepared.
Article 11 – Identity verification and compliance
Fiscasa may ask the Client for an identity document and any supporting document needed to meet its legal obligations, in particular anti-money laundering obligations where they apply. Failing this, Fiscasa may suspend or refuse the service.
Article 12 – Personal data and confidentiality
12.1. Fiscasa processes the Client's data in accordance with Regulation (EU) 2016/679 (GDPR) and amended French law no. 78-17 of 6 January 1978. The details are set out in the privacy policy.
12.2. Fiscasa undertakes to keep the Client's tax, financial and personal information confidential and to disclose it only to the persons and providers strictly necessary for the service, or to the tax authority when the Client so requests or the law requires.
12.3. Fiscasa never asks the Client for their Cl@ve credentials, digital certificate or bank codes.
Article 13 – Complaints and consumer mediation
13.1. Any complaint may be sent to customer service: [EMAIL] or [ADDRESS]. Fiscasa undertakes to reply within [RESPONSE PERIOD].
13.2. In accordance with articles L. 612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved after a prior written complaint to Fiscasa, a Client who is a consumer may refer the matter free of charge to the following consumer mediator:
- [MEDIATOR NAME]
- [MEDIATOR ADDRESS]
- [MEDIATOR WEBSITE]
The matter must be referred to the mediator within one year of the written complaint sent to Fiscasa.
Article 14 – Governing law and jurisdiction
14.1. These Terms are governed by French law. If the Client who is a consumer habitually resides in another Member State of the European Union, they retain the benefit of the mandatory provisions of the law of their country of residence.
14.2. Failing amicable resolution, the dispute will be brought before the competent court in accordance with the ordinary rules; the consumer may bring proceedings before the court of the place where they lived at the time the contract was concluded or the harmful event occurred.
Article 15 – Miscellaneous
If any clause of the Terms is declared void, the other clauses remain in force. Fiscasa's failure to rely on a clause does not constitute a waiver.
