Who has to file Modelo 210 in Spain?
Short answer
Anyone who is tax resident outside Spain and owns a Spanish home files Modelo 210: for imputed income when it is not let, for rent when it is, and for a gain when it is sold. Each co-owner files their own return.
The test is residence, not nationality
What matters is where you are tax resident. A British citizen living full time in Alicante is a Spanish resident and does not use Modelo 210 for their home. A Spanish citizen living in Dublin who keeps a flat in Madrid does. If you are unsure which side you fall on, read how residence is decided.
The three situations that trigger a return
A home you keep for yourself. If the property is empty, used for holidays or lent to family for free, you declare imputed income once a year. This is by far the most common case for owners in the UK and Ireland.
A home you rent out. Rental income is declared on the same form. Owners resident in the EU or EEA, including Ireland, may deduct expenses in proportion to the days let and pay 19%. Owners resident in the UK, the US or Switzerland pay 24% on the gross rent with no deductions.
A home you sell. The gain is declared on Modelo 210 after the sale, and the buyer withholds 3% of the price on account. That is a separate return from your annual one.
One owner, one property, one return
The form is personal. Two spouses who own a villa half each file two returns, each for 50%. Three siblings who inherited a flat file three. An owner with an apartment and a separate garage usually files for each property. The tax office does not accept one return covering several people. More detail is on couples and Modelo 210.
Every person who files needs a NIE, the Spanish foreigner identification number. A fiscal representative is optional if you live in the EU or EEA.
Who does not need it
Spanish tax residents report their property on the ordinary Spanish income tax return instead. Companies follow other rules. And if you have no Spanish property and no Spanish income, there is nothing to file. For a full walk-through of the form itself, see the complete Modelo 210 guide.
