How many years back can Spain claim non-resident tax?
Short answer
Four years, as a general rule. The Agencia Tributaria can assess unpaid Modelo 210 tax for the last four years. Older years are usually out of reach, so an owner who has never filed normally only needs to bring the four most recent ones up to date.
Run the numbers →The four-year limit
Spanish tax law gives the tax office four years to assess a tax debt. After that, the right lapses. For Modelo 210, this means that an owner who bought fifteen years ago and never filed does not face fifteen years of tax: in general, only the most recent four are still open.
The period does not start on 1 January of the income year. It runs from the end of the filing window for that year. Because imputed income is declared in the year after it arises, each year stays claimable a little longer than people expect. If you are close to the edge, an adviser can tell you whether a particular year is still open.
What can restart the clock
In general, any formal step by the tax office concerning that tax, such as a requerimiento or a proposed assessment, interrupts the period. So does filing a return or making a payment. That is one reason not to ignore a letter from the AEAT: once it has been sent, the year in question is no longer about to expire.
An illustration
Maeve, resident in Ireland, has owned a flat in Benalmádena since 2014 and has never filed. Her imputed income tax is about €230 a year at 19%. If she acts in late 2026, she does not need to deal with 2014 to 2020. She brings the recent years up to date, at a total cost of roughly four years of tax plus surcharges, rather than more than ten.
Why not just wait for the oldest year to expire
Because the surcharges on the younger years grow every month, and because a letter from the tax office removes the cheapest option. Filing voluntarily keeps the surcharge regime at 1% plus 1% per month, or 15% plus interest after a year, with a 25% reduction if you pay on time. An assessment started by the tax office can cost more.
The figures for each year are on late filing costs, and the step-by-step route is on never filed. The late-filing calculator totals everything.
