Do I need a fiscal representative in Spain as a non-resident owner?
Short answer
Usually not. For EU and EEA residents, and for the imputed income of a home you do not let, appointing a representante fiscal is optional. It becomes mandatory only in specific cases, such as when the tax office requires one, when you live in a country without effective tax information exchange, or with a permanent establishment.
What a fiscal representative is
A representante fiscal is a person or firm resident in Spain who acts as your official contact with the Agencia Tributaria. Letters are sent to them, and they handle your obligations on your behalf. Many owners confuse this formal role with simply having someone prepare their return. The two are different: anyone can help you file, but a fiscal representative is a legal appointment notified to the tax office.
When it is optional
For the typical foreign owner, it is not required:
- if you live in an EU or EEA country, appointing one is a choice, not an obligation;
- for the imputed income of a holiday home, whatever your residence, there is no general obligation.
You can file your own Modelo 210, use an online service or ask a gestor, and pay from abroad by bank transfer, all without a formal representative.
When it becomes mandatory
The obligation arises in specific situations:
- the tax office requests it, for example because of the nature or size of your activities in Spain;
- you are resident in a country without an effective exchange of tax information with Spain;
- you operate in Spain through a permanent establishment, such as a business rather than a private property.
When the obligation applies and no representative is appointed, a fine can be imposed. If you are unsure whether your case falls into one of these, ask before assuming you are exempt. Owners living outside Europe, or holding property through a structure, should check most carefully.
Representation versus convenience
Even when it is optional, some owners like having a Spanish address for official mail, because paper letters from the tax office may otherwise go to an old address. Other owners prefer to keep things simple: file on time each year, keep the payment receipts and update their address with the tax office. Both work.
If you mainly want someone to take care of the yearly return, compare the options in gestor, lawyer or online service and look at what the service costs.
